- be over 18 years old;
- use our Service on your own behalf (unless you are using our Service with the assistance of one of our approved partners who is completing the application on your behalf, for example, via a telephone service);

4. THE SERVICE WE PROVIDE TO YOU
4.1. We provide a service that allows you to search for loans and other credit products that may be available to you (“Products“), which are offered by our panel of lenders, as further described in this section 4 (“Service“).
4.2. You may access our Service in the following ways:
- through one of our partner’s websites, where we work in conjunction with our partner and our partner transfers you to us (for example, the website may contain the partner’s brand but it is us who is providing our Service);
- through one of our introducer’s websites when you have been referred to us from one of our introducers – for example when you have clicked through to our website from our introducer’s website or you have made an application with an introducer and that application has been transferred to us; or
- where you have applied to a lender and the lender has referred you to us as they weren’t currently able to provide you with a loan.
4.3. In order for us to provide our Service to you, you will need to complete an application form and provide us with some information about you. We tell you more about this in section 7.
4.4. We will undertake a soft credit search on you with our credit reference agency, TransUnion International UK Limited (formerly Callcredit). Their registered address is One Park Lane, Leeds, West Yorkshire, LS3 1EP and further details can be found here https://www.transunion.co.uk/legal-information/bureau-privacy-notice. We may use other credit reference agencies where necessary. This is for the purpose of validating your identity, assessing your eligibility for the Products and preventing fraud. This soft search will be recorded in your credit history, but is not visible to lenders and other providers (e.g. utility companies). It will not affect your credit score.
4.5. The answers you provide to us, along with the results of our soft credit search, will determine the Products we display to you as offers from our panel of lenders.
4.6. Depending on how you have accessed our Service:
- where you have accessed our Service through certain introducer websites, you will be transferred directly to the lender that has been selected for you based on your application form and the results of the soft credit search; or
- in all other cases, we will display the Products available to you from our panel of lenders. The Products will be displayed in the order of the lowest monthly payment first, except for when there is a high cost short term credit Product in the list (as described further in section 5.4). In this case, Products will be ranked in order of the total amount you will have to pay under each Product, with the Product with the lowest total amount payable first.
4.7. Sometimes a lender may offer you a Product for a higher or lower amount than you initially entered on your application form. This means you may be displayed a result which is different to the amount you originally applied for. It is important you consider the impact of this when deciding whether to go ahead with a Product.
4.8. Where we cannot find an appropriate Product for you, you may be passed over to one of our group companies (including Credit Intelligence Limited (t/a Credito), Credit Technologies Limited (t/a Credit Engine), or Moneyguru Limited) who may be able to find an alternative for you. The group company may pay us a commission for transferring you to them.
4.9. As part of our Service, we may follow-up with you and contact you from time to time in relation to your application and any Products you have requested from your selected lender. We may send you emails, texts or call you. We offer this to you free of charge. You may also receive these types of communications from any lenders/providers that we introduce you to, dependent on their policy.
5.1. We are a credit broker and not a lender.
We are a credit broker and not a lender – we will not provide a loan or any other credit product direct to you.
We cannot and will not advise you as to the suitability of any of the Products from a lender. It is for you to decide whether any Product is suitable for you.
The decision to offer any Product or any other financial service is made by the lender. The lender will conduct an assessment on you before any decision or offer is made; this will include a full assessment of your credit history past and present.
5.2. Information provided by our lenders
If you decide to proceed with your application for a loan with one of our lenders, we ask that you read the information provided by them carefully (including any terms they provide) before deciding to proceed with the Product. Your selected Product will be provided by your lender and governed by the terms that will be provided by your lender.
5.3. Representative examples
Unless the results show that you have been “Pre-Approved” (see section 5.5 below), any examples of amounts available to borrow, the repayment period or representative rates (rep APRs) stated on our website are purely given as a representative example relating to the Product. These representative examples are stated to give you an understanding of the Products available and to allow you to compare Products. Representative examples are not given as a figure of what you will actually be offered by the lender. Accordingly, they cannot be given as a guarantee nor can they be used as any kind of warranty. As we do not provide the Product, loan or financial service directly we are unable to control the representative rate examples contained on our website.
5.4. High cost short term credit
You may be transferred directly to a high cost short term credit provider, or where we display multiple Products available to you, some of those results may include high cost short term credit Products. It is important to bear this in mind when assessing whether a Product is suitable for your needs and circumstances. Please be aware that late repayment can cause you serious money problems. For help or further information, go to moneyadviceservice.org.uk.
5.5. “Pre-approved”
If your results show that a lender has pre-approved you for a loan this means they have conducted a soft search of your credit file and there is a good chance they will lend to you on the basis of the information you have provided. In these circumstances, the rates you see on the website will be the rates you will get subject to the lender’s further checks. It is important to note that pre-approval does not guarantee you a loan. All loans are subject to lender requirements and approval.
5.6 Commission
Where you have:
- accessed our Service through one of our partner’s websites;
- accessed our Service through one of our introducer’s websites; or
- where you have applied to a lender and the lender has referred you to us, we will usually pay the partner, introducer or lender (as applicable) a commission for having referred you to us. If you want to know the amount, please let us know.
Similarly, lenders will pay us a commission in certain circumstances. In some cases, if a lender provisionally accepts you for a particular Product we will receive a commission. In other cases, we will receive a commission if you actually choose that Product and enter into terms with that lender. Again, if you want to know the amount, please let us know.
These commission amounts will never be added to your loan.
6. LENDER CHECKS AND REFERENCING
In addition to the soft credit search we will undertake (as set out at section 4.4) the lenders we work with may use credit scoring facilities and credit referencing agencies to determine whether you are eligible for the loan you have applied for.
Credit checks and credit reference agencies can also help prevent fraudulent applications.
7. THE INFORMATION YOU PROVIDE
7.1. You are solely responsible for ensuring that all the information you provide to us is true, accurate, complete and not misleading. The answers you provide to us in your application will determine the Products and offers we display and make available to you.
7.2. We will rely on the information you give to us in order to provide our Service – if it is not accurate then this could lead to your results and any Products displayed being invalid, inappropriate or unavailable. You agree that we cannot be held responsible if your selected Product is invalid, inappropriate or unavailable as a result of you providing inaccurate information to us or your selected lender. This includes “pre-approved” Products. You should also be aware that providing inaccurate information may also breach any agreement you enter into with your selected lender.
7.3. If you give us false or inaccurate information and we identify fraud, details may be passed to credit reference and fraud prevention agencies, which may result in the instigation of criminal procedures against you.
8. HOW WILL WE USE YOUR PERSONAL INFORMATION?
We will only use personal information as set out in our Privacy Policy.
9. USAGE OF OUR WEBSITE AND CUSTOMER ACCESS
9.1. Our website and our Service is made available to you free of charge.
9.2. Subject to clause 12, we do not guarantee that our website or our Service will always be available or be uninterrupted or error-free, and we do not guarantee that our website will be secure or free from bugs or viruses.
9.3. We reserve the right to suspend or remove your access to the Service without giving you any prior notice to do so in the following circumstances:
- if we reasonably believe providing you with the Service will cause us to break a law, regulation, code or other duty which applies to us;
- for business and operational reasons; or
- should we have grounds to believe that you are in breach, or likely to be in breach, of these Terms.
9.4. Though we try and keep the information on our website up to date, there may be a time delay before we can do so. We may update and change the content of our website at any time. During any updates to our website, your access may be suspended completely.

All intellectual property rights pertaining to or contained on our website, in content or in any materials (including but not limited to copyrights, patents, database rights, graphics, designs, text, logos, trade dress, trademarks and service marks) are owned by us or we have a licence to use the same from a third party and all right, title and interest therein shall remain our property and/or the property of such third party (collectively, “Our IPR“). 10.4. - (a) we are not legally responsible for that loss or damage; or
- (b) it was not foreseeable by both parties pursuant to these Terms.
12.4. In accordance with section 12.3, the loss or damage we are not liable to you for includes (without limitation) any loss or damage arising under or in connection with:

12.5. We are not responsible for and will not be liable for any loss or damage you suffer arising from any Products or any other products or services provided by our lenders. These will be governed by their own terms and conditions provided by the lender.
12.6. We do not provide any guarantees in respect of your eligibility for or success in obtaining a Product. As explained in section 5, the decision to offer any loan or financial service is made by the lender – we have no control over the decision making.
